No Claim for Covid Business Interruption

Plaintiff is a chiropractic clinic which submitted a claim against its insurance company seeking business interruption benefits purportedly stemming from Covid related lockdowns. The lockdowns were caused, in part, by Gov. Gretchen Witmer’s numerous executive orders beginning in March 2020 which required businesses to shut down for 2 ½ months.

The defendant insurance company filed a motion for summary disposition. The Kent County Circuit Court granted the Defendant insurance company’s motion for summary disposition reasoning that Defendant insurance company’s policy provided no coverage where “the loss of business income was not caused by a direct physical loss or damage to the property.” Thus, the lack of a direct physical loss or damage to Plaintiff’s property precluded coverage.
