Alternative Dispute Resolution in Michigan State Courts
Partner Peter Angelas has participated in all aspects of the alternative dispute resolution (ADR) process over the past 35 years and currently sits as a case evaluator in both Wayne County Circuit Court and Oakland County Circuit Court. He's also served as a mediator and an arbitrator.
In this video, Peter explains the different types of ADR options available in Michigan courts and gives some background on each.
Mediation. This approach is the way that almost all cases get resolved short of trial.
Binding arbitration. Litigants can agree to this if they choose.
Facilitation. This is similar to mediation.
Mandatory Case Evaluation. This is a mandatory court ordered process that takes place after discovery. The case evaluators, who are chosen by the circuit courts, review the facts with both sides and then issue a monetary award indicating what they think the case should settle for. It is not suitable if equity is involved in a dispute.
