Michigan No-Fault: Provider’s Transfer of Account Valid
In this Michigan no-fault case, a medical provider provided services to two PIP claimants following a motor vehicle accident. The medical provider then assigned its claims to other entities in subsequent contracts. The Court of Appeals ruled that the medical provider can still pursue a reimbursement claim for no-fault benefits against the insurance company even though that provider transferred its interest to separate entities.
An assignment of benefits from a medical provider to a third-party company does not preclude a medical provider from maintaining its cause of action under MCL 500.3112. The Circuit Court’s contrary judgment was reversed and the case was remanded.
