Dash Cam Video from Truck Accident was Insufficient for Dismissal
Plaintiffs filed a lawsuit seeking personal injury damages for a cross-over motor vehicle accident between a semitruck and a SUV. The semitruck had a dash cam video. The dash cam video showed that the Plaintiffs’ vehicle crossed the center line into the semi-truck’s lane of travel. The Defendant sought summary judgment based upon the dash cam video. The Trial Court Judge denied the motion for summary judgment finding that questions of fact remained regarding who was at fault.
The Plaintiff driver during her deposition denied crossing the center line. The Plaintiff passengers offered deposition testimony that it was the semi-truck who crossed the center line. The dash cam video did not show the moment of impact. The Trial Judge felt that expert testimony was needed to resolve the issue of who was at fault for the MVA. The case was permitted to proceed.
